01

Privacy Policy

Explains how Advancelytics collects, uses, processes, protects, and governs information across the website, platform, AI agent, embedded widget, dashboard, integrations, and knowledge base tools.

1.1 Scope of this Policy

This Privacy Policy applies to visitors to Advancelytics websites, businesses that create an Advancelytics account, authorized users of customer accounts, prospective customers, and website visitors who interact with an Advancelytics-powered widget, AI agent, form, chat, or engagement experience on a customer website. Where Advancelytics processes data on behalf of a business customer, Advancelytics generally acts as a service provider or data processor. The business customer is responsible for determining what data is collected from its website visitors, providing legally required notices, and obtaining any legally required consents.

1.2 Information We Collect

Advancelytics may collect account and business information, website visitor and behavioral data, AI chat and conversation data, knowledge base and uploaded content, and technical usage data needed to provide, secure, improve, and support the Services.

1.3 How We Use Information

Advancelytics may use information to provide, operate, and maintain the platform, power AI chat and engagement experiences, generate visitor journey insights, detect decision friction and conversion readiness, identify lead quality and lead intent, support human handoff with relevant visitor context, create customer journey maps, provide analytics and reporting, improve product performance, respond to support requests, secure accounts, monitor system performance, process billing and subscriptions, communicate product updates, comply with legal obligations, and enforce our terms and policies.

1.4 Website Behavior Tracking and Decision Intelligence

Advancelytics uses first-party tracking and decision intelligence technology to help businesses understand how visitors interact with their website, AI agent, forms, and customer engagement experiences. This may include collecting and analyzing website interaction data such as page views, visited URLs, referral source, session activity, scroll behavior, button or CTA interactions, time spent on pages, repeated visits, inactivity, exit-intent behavior, pricing-page engagement, feature-page interest, comparison behavior, lead progression, and drop-off risk. Advancelytics uses this data to generate visitor journey insights, lead intelligence, decision-readiness signals, hesitation indicators, AI engagement triggers, human handoff context, and customer journey analytics. When Advancelytics is installed on a customer’s website, the customer is responsible for providing appropriate privacy notices and obtaining any legally required consent from website visitors for the use of Advancelytics, cookies, local storage, session identifiers, AI chat, lead capture, journey analytics, behavioral tracking, and any other analytics or tracking technologies enabled on the customer’s website.

1.5 AI Features and Automated Insights

Advancelytics uses artificial intelligence and machine learning technologies to generate insights, classifications, recommendations, summaries, lead scores, conversation evaluations, and decision-support signals. AI-generated outputs may include visitor intent classification, lead readiness indicators, hesitation signals, journey-stage summaries, conversation summaries, suggested responses, recommended next actions, risk indicators, customer journey interpretations, agent performance insights, and resolution quality scoring. AI outputs are probabilistic and may be incomplete, inaccurate, outdated, or unsuitable for a specific situation. Advancelytics does not guarantee that any AI-generated score, classification, recommendation, summary, or prediction will be accurate or lead to a specific business result. Customers are responsible for reviewing AI outputs before relying on them.

1.6 Customer Responsibility

Customers are responsible for providing accurate privacy notices on their own websites, obtaining legally required consent from website visitors, ensuring lawful use of cookies, tracking, AI chat, lead capture, analytics, and uploaded content, avoiding collection of sensitive personal information unless legally permitted, reviewing AI-generated outputs before use, and ensuring their use of Advancelytics complies with applicable laws.

1.7 Sensitive Information

Customers must not intentionally collect, submit, upload, or process sensitive personal information through Advancelytics unless expressly permitted in writing by Advancelytics and supported by an appropriate legal agreement. Sensitive information may include credit card numbers, bank account details, passwords, one-time passcodes, government identification numbers, health information, biometric information, children’s data, precise geolocation, highly sensitive financial information, and other regulated personal information. Advancelytics is not a payment processor and should not be used to collect payment card data, banking information, passwords, or authentication credentials through chat, forms, or AI conversations.

1.8 Sharing of Information

Advancelytics may share information with service providers and subprocessors only as needed to provide, secure, maintain, and improve the Services. These may include hosting providers, database providers, AI model providers, email and communication providers, analytics and monitoring providers, payment processors, security and fraud prevention providers, customer support tools, professional advisors, and legal or regulatory authorities where required. Advancelytics does not sell personal information as a core business practice.

1.9 Data Retention

Advancelytics retains information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business purposes. Customer data may be retained during the active subscription period and for a reasonable period after termination unless earlier deletion is required by law or requested under an applicable agreement. Aggregated or de-identified data may be retained for analytics, product improvement, and business intelligence purposes.

1.10 Privacy Requests from Website Visitors

If you are a website visitor who interacted with Advancelytics on a customer’s website, please contact that business directly to exercise privacy rights relating to your data. Advancelytics usually processes such data on behalf of the customer. The customer is responsible for determining how visitor data is collected and used on its website. Where required by applicable law or agreement, Advancelytics will provide reasonable assistance to customers in responding to valid privacy requests.

1.11 Data Security

Advancelytics uses reasonable technical and organizational measures designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. These measures may include secure authentication, access controls, encrypted transmission where applicable, role-based access controls, limited employee access, system monitoring, logging, secure infrastructure practices, vulnerability management, and internal data handling controls. No system is completely secure. Customers and users are responsible for maintaining the confidentiality of login credentials and using secure practices when configuring the platform.

1.12 International Data Processing

Advancelytics and its service providers may process information in countries where Advancelytics or its subprocessors operate. These countries may have data protection laws different from the country where a user or customer is located. Where required, Advancelytics will use appropriate safeguards for international data transfers.

1.13 Your Rights

Depending on location, individuals may have rights to access personal information, correct inaccurate information, delete information, restrict or object to processing, request portability, withdraw consent, or opt out of certain processing activities. If a visitor is interacting with Advancelytics on a customer’s website, that visitor should contact the relevant business first because the customer is usually the controller of the data. Privacy contact: privacy@advancelytics.com.

03

Customer Terms of Service

Defines customer responsibilities, website installation obligations, billing authorization, refund rules, customer data rights, AI output limitations, permitted use, restrictions, suspension rights, disclaimers, and liability boundaries.

3.1 Use of Services

Advancelytics provides software services that help businesses understand website visitor behavior, detect decision friction, engage visitors through AI, qualify leads, analyze customer journeys, and generate decision-support insights. Customers may use the Services only in accordance with these Terms, applicable laws, and any order form, subscription agreement, or written agreement with Advancelytics.

3.2 Free Trial Terms

Advancelytics may offer a free trial that allows businesses to create an account and use the Services with limited access, limited usage, limited credits, limited leads, limited conversations, limited AI responses, limited tracked visitors, or other trial restrictions determined by Advancelytics. Free trial access is provided for evaluation purposes only. Advancelytics may modify, limit, suspend, or end free trial access at any time if there is misuse, abuse, suspected fraud, excessive usage, violation of these Terms, or risk to the platform. Unless otherwise stated in writing, free trial access does not guarantee continued access to the same limits, features, data, pricing, or functionality after the trial ends. Data created or collected during the free trial may be deleted, restricted, or become inaccessible if the customer does not upgrade to a paid plan or if the account remains inactive. Advancelytics is not responsible for any loss of data, leads, configuration, reports, AI outputs, visitor journey data, or account history after a free trial expires, is suspended, or is not converted to a paid subscription.

3.3 Customer Responsibilities

Customer is responsible for all use of the Services under its account, all data, content, URLs, documents, and materials submitted to Advancelytics, ensuring it has the legal right to process customer and visitor data, providing privacy notices to website visitors, obtaining legally required consent, configuring the AI agent accurately, reviewing AI outputs, maintaining account security, ensuring authorized users comply with these Terms, and complying with all applicable laws and regulations. Customer must ensure that its website visitors are informed that AI chat, behavior tracking, lead capture, journey analytics, and decision intelligence technologies may be used.

3.4 Customer Responsibilities for Website Installation and Data Use

By creating an account, installing Advancelytics on a website, activating the AI agent, uploading knowledge base materials, connecting website URLs, or using the Services, Customer represents and warrants that it has all necessary rights, notices, permissions, and consents required to use Advancelytics. This includes, where applicable, the use of AI chat, behavior tracking, lead capture, journey analytics, cookies, local storage, session identifiers, visitor interaction analysis, human handoff context, and processing of submitted content, sitemap URLs, website pages, uploaded documents, or knowledge base materials. Customer is responsible for providing appropriate privacy notices and obtaining any legally required consent from website visitors, end users, employees, representatives, or other individuals whose information may be processed through the Services. Advancelytics is not designed to collect or process payment card data, passwords, banking details, health information, children’s data, government identification numbers, or other sensitive regulated information. Customer must not intentionally submit, collect, request, or process such information through the Services unless expressly agreed in a separate written agreement with Advancelytics. Customer is responsible for ensuring that its use of Advancelytics complies with applicable laws, regulations, industry requirements, and third-party terms.

3.5 Widget Installation and Website Impact

Customer is responsible for correctly installing, configuring, testing, and maintaining the Advancelytics widget, script, AI agent, or related tracking technology on its website. Advancelytics is not responsible for website errors, layout issues, performance impact, tag conflicts, script conflicts, consent-banner conflicts, broken tracking, inaccurate data, blocked events, or incomplete visitor journeys caused by customer implementation, third-party scripts, website changes, browser restrictions, consent settings, or incorrect configuration. Customer is responsible for testing the Advancelytics installation before publishing it on a live website.

3.6 Account Security and Authorized Users

Customer is responsible for maintaining the confidentiality of account credentials, passwords, API keys, widget keys, admin access, and authorized user permissions. Customer is responsible for all activity that occurs under its account, including actions taken by employees, contractors, representatives, agents, or other authorized users. Customer must promptly notify Advancelytics of any suspected unauthorized access, credential compromise, security incident, or misuse of the Services.

3.7 Lead Capture and Follow-Up Communications

Customer is responsible for ensuring that any email, SMS, phone, WhatsApp, social messaging, or other follow-up communication sent to leads, website visitors, or end users complies with applicable consent, marketing, anti-spam, telemarketing, privacy, and communication laws. Advancelytics is not responsible for Customer’s use of exported leads, CRM data, contact details, or follow-up communications outside the Services. Customer must not use Advancelytics to collect or contact individuals in a manner that is unlawful, deceptive, harassing, or inconsistent with applicable consent requirements.

3.8 Billing Authorization, Subscription Use, and Dispute Records

By selecting a paid plan, starting a subscription, submitting payment information, upgrading, renewing, or continuing to use Advancelytics after activation, Customer authorizes Advancelytics and its payment processor to charge the selected payment method according to the applicable plan, billing cycle, pricing, renewal terms, and refund policy shown at the time of purchase. Customer is responsible for reviewing the selected plan, subscription price, billing cycle, renewal date, cancellation terms, and refund terms before completing payment. Unless otherwise stated in writing, subscriptions renew automatically until cancelled by Customer in accordance with the cancellation process made available by Advancelytics. Because Advancelytics provides access to digital software, AI configuration, website tracking, knowledge base processing, visitor journey analytics, lead intelligence, decision intelligence, and usage-based insights, subscription fees are generally non-refundable once the Services have been activated, configured, or used. Refunds may be reviewed case-by-case where there is duplicate billing, an incorrect charge, or a verified technical failure caused by Advancelytics. Advancelytics may retain relevant account, billing, consent, subscription, usage, support, security, and system records for legitimate business purposes, including fraud prevention, payment verification, chargeback defense, dispute resolution, compliance, and enforcement of these Terms. Such records may include, where applicable, account owner name, email address, company name, website domain, IP address, signup timestamp, accepted terms version, selected plan, billing amount, billing cycle, invoice ID, payment timestamp, payment processor transaction ID, product activation events, website script installation, AI agent activation, knowledge base setup, sitemap or URL connection, uploaded documents, visitor sessions tracked, leads captured, reports viewed, support communications, cancellation requests, and refund history. Advancelytics may suspend or restrict access to the Services if it detects suspicious payment activity, unauthorized use, disputed charges, abuse, fraud risk, security risk, or violation of these Terms.

3.9 Refund and Cancellation Policy

Customers may cancel future subscription renewals at any time through the account dashboard, billing portal, or by contacting Advancelytics support. Cancellation stops future renewals but does not automatically refund fees already charged. Because Advancelytics provides immediate access to digital software, AI agent setup, website behavior tracking, knowledge base processing, visitor journey analytics, lead intelligence, reports, and usage-based insights, subscription fees are generally non-refundable once the Services have been activated, configured, or used. Refunds may be reviewed at Advancelytics’ discretion in limited cases, including duplicate billing, incorrect charge, verified billing error, or verified technical failure caused by Advancelytics that prevented meaningful use of the Services. Refunds are not guaranteed for failure to cancel before renewal, lack of usage after activation, change of mind, misconfiguration by Customer, Customer’s failure to install or use the platform after purchase, Customer’s failure to provide required website notices or visitor consents, or violation of these Terms or Acceptable Use Policy. If a refund is approved, Advancelytics may issue the refund to the original payment method or provide account credit, at its discretion.

3.10 Payment and Subscription Terms

Customer is responsible for all fees, taxes, charges, and subscription amounts associated with its use of the Services. Payments may be processed through third-party payment providers. Advancelytics does not store full payment card numbers or full banking credentials. Unless otherwise stated in writing, subscription fees are non-refundable once a billing period begins. Advancelytics may suspend, restrict, or terminate access to the Services for failed payments, overdue invoices, disputed payments, reversed payments, chargebacks, suspected payment fraud, or violation of these Terms. Customer is responsible for maintaining accurate billing information and ensuring timely payment of all applicable charges.

3.11 Customer Data

As between Customer and Advancelytics, Customer owns Customer Data. Customer grants Advancelytics a limited, worldwide, non-exclusive license to access, process, store, transmit, display, and use Customer Data only as necessary to provide the Services, maintain and secure the platform, generate analytics and insights, support AI features, provide customer support, improve the platform, comply with legal obligations, and create aggregated or de-identified insights. Advancelytics may use aggregated or de-identified data for product improvement, benchmarking, analytics, research, and business intelligence, provided such data does not directly identify Customer or any individual.

3.12 Data Export, Deletion, and Backup Limitations

Customer may request export or deletion of certain Customer Data, subject to technical availability, legal obligations, backup retention, security requirements, dispute resolution needs, and legitimate business purposes. Deleted data may continue to exist in backups, logs, or archival systems for a limited period before being overwritten or securely deleted according to Advancelytics’ standard retention practices. Advancelytics may retain aggregated, de-identified, security, billing, or compliance-related records where permitted by law.

3.13 AI Outputs and Decision-Support Disclaimer

Advancelytics uses artificial intelligence and machine learning technologies to generate insights, classifications, recommendations, summaries, lead scores, conversation evaluations, and decision-support signals. AI-generated outputs may include visitor intent classification, lead readiness indicators, hesitation signals, journey-stage summaries, conversation summaries, suggested responses, recommended next actions, risk indicators, customer journey interpretations, agent performance insights, and resolution quality scoring. Customer acknowledges that AI-generated outputs are probabilistic and may be incomplete, inaccurate, outdated, or unsuitable for a specific situation. Advancelytics does not guarantee that any AI-generated score, classification, recommendation, summary, prediction, or insight will be accurate or produce a specific business outcome. Customer is responsible for reviewing and validating AI outputs before relying on them. Advancelytics should be used as a decision-support system and must not be used as the sole basis for decisions that may produce legal, financial, employment, healthcare, credit, housing, or similarly significant effects on an individual.

3.14 AI Model Processing and Training Clarification

Advancelytics may send prompts, conversation context, knowledge base excerpts, visitor interaction data, summaries, classifications, or other necessary data to AI model providers solely to provide AI-powered features within the Services. Advancelytics does not permit third-party AI model providers to use Customer Data to train public foundation models unless Customer expressly agrees otherwise or such use is clearly disclosed in a separate written agreement. Customer acknowledges that AI-powered features may depend on third-party model providers, infrastructure providers, and retrieval systems used to generate responses, summaries, classifications, recommendations, and insights.

3.15 Tracking Accuracy and Signal Limitations

Decision signals, hesitation indicators, readiness states, journey stages, lead scores, drop-off risk classifications, and recommended next actions are generated from available behavioral, technical, and interaction data. These signals are estimates and may be incomplete, delayed, inaccurate, or affected by missing data, browser restrictions, cookie settings, consent settings, ad blockers, script blockers, network conditions, user behavior, or customer configuration. Customer should treat these outputs as business intelligence indicators and decision-support insights, not definitive facts.

3.16 Visitor Identification and Attribution Limitations

Advancelytics may use session identifiers, browser signals, device signals, submitted contact information, and similar technologies to support visitor journey continuity and returning visitor analysis. Advancelytics does not guarantee that a returning visitor, lead, session, company, or user will always be accurately identified, matched, attributed, or connected to previous activity. Browser settings, private browsing modes, device changes, cookie deletion, shared devices, VPNs, consent preferences, ad blockers, script blockers, and technical limitations may affect visitor identification, journey continuity, and attribution accuracy.

3.17 Human Handoff Context Disclaimer

Where the Services provide human handoff context, visitor summaries, journey history, recommended next steps, decision barriers, risk indicators, or conversation summaries, such information is generated from available data and may be incomplete, delayed, or inaccurate. Customer’s human agents, representatives, or team members are responsible for reviewing the context, verifying information, and deciding how to respond to visitors, leads, or customers.

3.18 No Guaranteed Business Outcome

Advancelytics provides decision-support insights, behavioral analytics, AI engagement, visitor journey intelligence, and lead intelligence tools. Advancelytics does not guarantee that use of the Services will result in increased revenue, higher conversion rates, improved lead quality, reduced churn, closed deals, successful customer engagement, or any specific business outcome. Customer remains responsible for its sales, marketing, support, operational, business, and customer communication decisions.

3.19 Knowledge Base Crawling, URLs, and Uploaded Content

Customer is responsible for ensuring that any sitemap URL, website URL, document, webpage, knowledge base material, help article, FAQ, internal content, or other submitted material may lawfully be accessed, scraped, indexed, stored, embedded, summarized, and used to generate AI responses. Advancelytics does not verify ownership, copyright status, confidentiality, accuracy, completeness, or legality of customer-submitted content. Customer must not submit third-party content, private content, paywalled content, confidential content, restricted content, or regulated data unless Customer has the legal right and required permissions to do so. Customer remains responsible for the accuracy, legality, completeness, and maintenance of all knowledge base materials and website content submitted to Advancelytics.

3.20 Third-Party Services and Integrations

The Services may integrate with or rely on third-party platforms such as CRMs, communication tools, scheduling tools, payment providers, hosting providers, AI providers, database providers, email providers, or analytics tools. Customer is responsible for its use of third-party services, maintaining third-party accounts, complying with third-party terms, ensuring third-party integrations are configured lawfully, and understanding how third-party services process data. Advancelytics is not responsible for third-party services, outages, data handling, or policy changes.

3.21 Customer Website and Third-Party Website Disclaimer

Advancelytics may be embedded on websites owned or controlled by customers. Advancelytics is not responsible for the content, privacy practices, security, cookie banners, consent flows, website performance, accessibility, third-party scripts, or legal compliance of customer websites. Customer is responsible for ensuring that its website, policies, consent mechanisms, and third-party tools comply with applicable laws.

3.22 Product Changes and Feature Updates

Advancelytics may modify, improve, replace, suspend, or discontinue features, modules, reports, integrations, dashboards, AI capabilities, tracking methods, or platform workflows from time to time. Advancelytics will use reasonable efforts not to materially reduce core paid functionality during an active subscription period unless required for security, legal, technical, operational, or platform reliability reasons. Customer acknowledges that product features, limits, reports, AI outputs, scoring methods, and workflows may evolve over time.

3.23 Beta and Early Access Features

Advancelytics may offer certain features, modules, dashboards, reports, AI workflows, integrations, or experimental capabilities as beta, preview, early access, trial, or evaluation features. Beta and early access features may be incomplete, contain errors, change without notice, or be discontinued at any time. Customer agrees that beta and early access features are provided ā€œas isā€ and should not be relied upon for critical business decisions without independent review.

3.24 Restrictions

Customer must not use the Services unlawfully, upload content it does not have rights to use, use the Services to collect payment card data, passwords, bank details, or sensitive regulated information, use the Services for surveillance, stalking, or unauthorized monitoring, use the Services to make high-impact decisions without human oversight, reverse engineer, copy, decompile, or attempt to extract source code, attempt to bypass usage limits or security controls, interfere with platform performance, use the Services to build a competing product, submit malicious prompts or attempt prompt injection, attempt to reveal system prompts, hidden instructions, credentials, or security controls, or use the Services for spam, phishing, fraud, harassment, or deceptive activity.

Advancelytics will not be liable for losses, lost profits, lost opportunities, or other damages resulting from a suspension or restriction made in good faith under these Terms.

3.26 Disclaimer

The Services are provided on an ā€œas isā€ and ā€œas availableā€ basis, except as expressly stated in a written agreement. Advancelytics does not guarantee that the Services will be uninterrupted or error-free, AI outputs will be accurate, lead scores will predict actual conversion, decision signals will always be correct, the platform will produce a specific business outcome, or all errors will be corrected. Customer uses the Services at its own discretion and remains responsible for its business decisions.

3.27 Limitation of Liability

To the maximum extent permitted by law, Advancelytics will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost data, lost business opportunities, or reputational harm.
